Arrest of a U.S. Citizen in Laos
Americans traveling or living in Laos are subject to the laws of the People’s Democratic Republic of Laos. Please bear in mind that the Embassy has limited jurisdiction in the assistance it can provide to Americans arrested in Laos. The US Government has no funds for the legal fees or other expenses of an American arrested in Laos.
Although consular officers cannot serve as your attorney or provide legal advice, they can supply Americans with a list of attorneys and assist in finding legal representation.
However, neither the U.S. Department of State, nor the Consular Section can assume any responsibility for the caliber, competence, or professional integrity of these attorneys. While a consular officer will do whatever he/she can to protect your legitimate interests and ensure you are not discriminated against under local law, a consular officer cannot release prisoners, provide guarantees of their comportment, or provide funds for bail. If you are arrested, immediately ask that a consular officer at the US Embassy be notified. If you are turned down, keep asking politely, but persistently. If unsuccessful, attempt to have someone to contact the embassy on your behalf.
Upon learning of an arrest, a U.S. consular officer will request permission fro the Lao government to visit the prisoner and provide a list of local attorneys, inform the Department of State about the arrest, and, if requested, contact the prisoner’s family and friends. Consular officers can help transfer money and deliver clothing and food from friends and family. They will also try to ensure that the prisoner is held under humane or healthy conditions or that the prisoner is treated as equitably as others in the same situation. The Embassy has compiled the following list of Lao law firms willing to assist English-speakers with a wide variety of legal concerns. It may be necessary for Americans to hire their own translator.
